TERMS & CONDITIONS SUMMARY
1. Scope
1.1. These General Terms and Conditions (GTC) apply to all business relations between EBENHOLZ skincare e.K., Auf dem Gesetz 7a, 56075 Stolzenfels ("Seller") and the customer ("Customer"), in their version valid at the time of order.

1.3. Consumers, as per these GTC, are individuals conducting transactions for purposes outside their commercial or independent professional activities (§ 13 BGB).
1.4. Divergent customer conditions are not acknowledged unless explicitly agreed upon by the seller.
2. Offers and Service Descriptions
2.1. Product representations in the online shop are non-binding and not legally binding offers.
2.2. All offers are valid "while supplies last," unless stated otherwise. Errors excepted.
3. Ordering Process and Contract Conclusion
3.1. Customers can select products and add them to the cart using the [Add to Cart] button. Orders are finalized via the [Proceed to Checkout] button.
3.2. By clicking [Buy], the customer submits a binding purchase request. Data can be reviewed and corrected before submission.
3.3. The seller sends an automatic order confirmation, which documents receipt but is not a contract acceptance. The contract is concluded when the seller ships the product or confirms shipment within 2 days.
3.4. For prepayment, the contract is concluded upon providing bank details and payment request. If payment is not received within 10 days after order confirmation, the order is void.
4. Prices and Shipping Costs
4.1. Prices include statutory VAT.
4.2. Shipping costs are additional and clearly communicated during the ordering process.
5. Delivery and Product Availability
5.1. For prepayment orders, delivery occurs post-payment receipt.
5.2. Partial deliveries are allowed if reasonable for the customer.
5.3. If delivery fails after three attempts due to customer fault, the seller may withdraw from the contract.
5.4. If a product is unavailable, the seller may withdraw from the contract and refund the customer or offer a comparable product.
5.5. Delivery times and restrictions are communicated on a separate information page or within product descriptions.
6. Payment Methods
6.1. Available payment methods are communicated during the ordering process.
6.2. Payment on invoice is due within 30 days of receiving the product and invoice. All other payments are due in advance.
6.3. Third-party payment processing terms apply.
6.4. Default occurs if payment is not made by the due date.
6.5. Default interest and further damages may be claimed.
6.6. Set-off rights are only granted for undisputed or legally established claims. Retention rights are limited to claims from the same contract.
7. Retention of Title
Products remain the property of the seller until fully paid.
8. Warranty and Guarantees
8.1. Warranty follows statutory provisions. 8.2. Guarantees are only provided if explicitly stated.
9. Liability
9.1. The seller's liability for damages is limited as follows:
9.2. Unlimited liability for intent and gross negligence.
9.3. Liability for slight negligence only for essential duties jeopardizing contract fulfillment, limited to foreseeable damages.
9.4. No liability for slight negligence outside of essential duties.
9.5. Exclusions do not apply to injury, health damage, guaranteed product conditions, or fraudulent concealment. Product Liability Act claims remain unaffected.
10. Storage of Contract Text
10.1. Customers can print the contract text before submitting the order.
10.2. Order confirmation includes all order data, GTC, withdrawal instructions, and shipping/payment terms. Registered customers can view past orders in their profile. The contract text is stored but not accessible online.
11. Data Protection
11.1. Personal data is processed according to legal requirements.
11.2. Data provided for order processing is confidential and not disclosed to unauthorized third parties.
11.3. Service providers assisting in contract execution may receive necessary data. Data for delivery is shared with the shipping company; payment data is shared with the payment processor.
11.4. Customers have rights to free information, correction, blocking, and deletion of their data, barring legal retention obligations.

12. Jurisdiction, Applicable Law, Contract Language
12.1. The seller's location is the place of jurisdiction for merchants, public law entities, or public law special funds.
12.2. Contract language is German.
